Welcome to Degen Desk. These Terms of Service (“Terms”) govern your use of the Degen Desk website at degendesk.xyz and the Degen Desk mobile app (together, the “Service”). By using the Service you agree to these Terms.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use Degen Desk. By using the Service you represent that you meet this requirement.

2. Your account

You sign in with a Google account. You are responsible for keeping your credentials secure and for all activity that happens under your account. Please notify us immediately if you believe your account has been compromised.

3. Subscriptions and payment

Degen Desk offers a free tier and a Pro subscription with additional features. Pro pricing and billing differ by platform:

• Website (Stripe): $14.99/month or $149.99/year, billed through Stripe.
• iOS app (Apple In‑App Purchase): $18.99/month or $189.99/year, billed through Apple. The yearly plan includes a 3‑day free trial. Payment is charged to your Apple ID at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage and cancel subscriptions at any time in Settings → Apple ID → Subscriptions on your iOS device. Any unused portion of a free trial is forfeited when you purchase a subscription.

Except where required by law, payments are non‑refundable. For iOS purchases, refund requests must be submitted to Apple.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose.
• Reverse engineer, decompile, or attempt to extract the source code of the Service.
• Scrape, spam, or make automated requests at a rate that degrades the Service for others.
• Use the Service to harass, threaten, or defraud others.
• Attempt to bypass Pro feature gates or subscription requirements.
• Use the Service to give financial advice to third parties as if you were a licensed advisor.

5. AI‑generated content

The Degen Desk agent is powered by AI. Responses may be inaccurate, out of date, or incomplete. You are solely responsible for any decisions you make based on output from the Service. Do not rely on AI output for financial, legal, medical, or safety‑critical decisions.

6. Market data

Degen Desk displays public market data from third‑party sources. We do not guarantee the accuracy, completeness, or timeliness of this data. Token prices and information may be delayed or incorrect.

7. Referral program

If you participate in our referral program, you agree to refer users honestly and not to engage in spam, fake sign‑ups, self‑referral, or deceptive promotion. We may withhold commissions and terminate accounts that violate these rules.

8. Intellectual property

Degen Desk and its content, logos, and trademarks are owned by us. We grant you a limited, non‑exclusive, non‑transferable license to use the Service for personal, non‑commercial purposes in accordance with these Terms.

9. Termination

We may suspend or terminate your access to the Service at any time for any reason, including breach of these Terms. You may stop using the Service at any time. Provisions that by their nature should survive termination (including limitation of liability, disclaimers, and dispute resolution) will survive.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR FREE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEGEN DESK AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR TRADING LOSSES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR (B) $50 USD.

12. Indemnification

You agree to defend, indemnify, and hold harmless Degen Desk and its operators from any claims, losses, or damages arising from your use of the Service or your violation of these Terms.

13. Changes to the Service and Terms

We may modify or discontinue parts of the Service at any time. We may also update these Terms from time to time. If we make material changes, we will post the updated Terms here and update the “Last updated” date. Continued use of the Service after changes take effect constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the United States and the State in which the Service is operated, without regard to conflict of law principles.
